Terms of Use

Welcome to Your Scholarships.  These Terms of Use apply to the Your Scholarships website located at YourScholarships.com, College Guidance Consultants, and all associated websites linked to Your Scholarships, its subsidiaries and affiliates, (collectively, the "Site" or "Company"). The Site is the property of Your Scholarships, and its licensors. By using the site, you agree to these terms of use.

Your Scholarships reserves the right to modify, add or remove portions of these Terms of Use at its sole discretion and at any time. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

In a Nutshell

1. Don't steal any of our information.
2. Only ONE person is allowed to use an account, and any information obtained is only for that ONE person who registered.
3. We can disable your account for any, or no reason.  If you paid, you'll get your money back, pro-rated to the time your account was deleted.
4. We link to other sites.  Click them at your own risk. We are NOT responsible for anything on those other site.
5. We use Paypal for subscriptions. We're not responsible for any mistakes THEY make.  You should read their Legal Agreements .
6. We've got ads from other sites.  We're not responsible for the content of the ads, or of the sites they link to.
7. We won't sell your email address to any "spam" companies, but we reserve the right to collect and disseminate any browser, or server information we may collect. Including, but not limited to, IP address, browser type, or location. But that's just so we can make the site run better.

Registration, Passwords and Security

In consideration of your use of the Site, you agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security of your password and identification; (c) maintain and promptly update the Registration Data, and any other information you provide to Company, to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and for any actions that take place using your account.

Rights to the Content

All content on the Site and available through the Service, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the "Site Content"), are the proprietary property of the Company, its users or its licensors with all rights reserved. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the Company's prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the Site. Provided that you are eligible for use of the Site, you are granted a limited license to access and use the Site and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Except for your own User Content, you may not upload or republish Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Such license is subject to these Terms of Use and does not permit use of any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the Site or the Site Content other than as specifically authorized herein, without the prior written permission of Company, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.

Disclaimers

The Site and the Service may be temporarily unavailable from time to time for maintenance or other reasons. Company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications. The Company is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to User's or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Web and/or in connection with the Service, including any Mobile Client software. Under no circumstances will the Company be responsible for any loss or damage, including any loss or damage to any User Content or personal injury or death, resulting from anyone's use of the Site or the Service, any User Content or Third Party Applications, Software or Content posted on or through the Site or the Service or transmitted to Users, or any interactions between users of the Site, whether online or offline.

Feedback and Information

Any feedback or communication you provide at this site shall be deemed to be non-confidential. Your Scholarships shall be free to use such information on an unrestricted basis.

Governing Law; Dispute Resolution

You agree that all matters relating to access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Texas without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Harris County, Texas, and you waive any objection to such jurisdiction or venue. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event that any controversy or dispute between Your Scholarships and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

Indemnity

You agree to defend, indemnify and hold Your Scholarships, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Your Scholarships by any third party due to or arising out of or in connection with your use of the Site.

Links to Other Sites

This Site contains links to various other, independent, third-party Web sites ("Linked Sites"). We are not responsible for any content, information, or other materials available on those sites. If you access any Linked Sites, you do so at your own risk.

Limitation of Liability

Except where prohibited by law, in no event will Your Scholarships be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits. The total liability from any and all claims will not exceed $100.

Your Scholarships’s failure to insist on or enforce strict performance of these Terms of Use shall not be construed as a waiver by Your Scholarships of any provision or any right it has to enforce these Terms of Use, nor shall any course of conduct between Your Scholarships and you or any other party be deemed to modify any provision of these Terms of Use. These Terms of Use shall not be interpreted or construed to confer any rights or remedies on any third parties.

Privacy Policy

When you visit Your Scholarships you provide us with two types of information: personal information you knowingly choose to disclose that is collected by us and Web Site use information collected by us as you interact with our Web Site.

When you register, you provide us with certain personal information.
When you enter the Site, we reserve the right to collect your browser type and IP address, and any information that accesible through the Web Server. In addition, we store certain information from your browser using "cookies." A cookie is a piece of data stored on the user's computer tied to information about the user. We use session ID cookies to confirm that users are logged in. By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you come back. Additional terms and conditions may apply to purchases of goods or services and to specific sections or features of the Site, including all contests, promotions or other similar features, all of which terms are made a part of these Terms of Use by this very reference. Violation of Terms of Use

Your Scholarships may disclose any information we have about you (including your identity) if we have determined that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Your Scholarships’s rights or property, or the rights or property of visitors to or users of the Site, including Your Scholarships’s customers. Your Scholarships reserves the right at all times to disclose any information that Your Scholarships deems necessary to comply with any applicable law, regulation, legal process or governmental request. Your Scholarships also may disclose your information if and when it has been determined that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

You acknowledge and agree that Your Scholarships may preserve transmittal or communication by you with Your Scholarships through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or Your Scholarships determines that such preservation or disclosure is reasonably necessary to:
1. Comply with legal process
2. Enforce these Terms of Use
3. Respond to claims that any such data violates the rights of others, or
4. Protect the rights, property or personal safety of Your Scholarships, its employees, users of or visitors to the Site, and the public.

If Your Scholarships takes any legal action against you as a result of your violation of these Terms of Use, Your Scholarships will be entitled to recover from you, and you will agree to pay, all reasonable attorneys’ fees and costs of any such action, in addition to any other relief granted to Your Scholarships. You agree that Your Scholarships will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

Void Where Prohibited

Any offer for any feature, product or service made on the Site is void where prohibited. If you choose to access the Site from outside the United States, you do so on your own initiative and you are solely responsible for complying with applicable local laws.
